TERMS OF SERVICE

Photographers retain copyright of the photos they upload. Event organisers retain ownership of their event and are responsible for obtaining appropriate consent from guests. Guests may download and use their own photos for personal use only. TIME&SPACE provides a limited service to match, store, and deliver photos. We are not liable for technical failures. By using this platform, you accept these terms in full.

Acceptance of terms

By accessing or using TIME&SPACE (timeandspace.app), you agree to be bound by these Terms of Service. If you do not agree, do not use the platform.

These terms apply to all users: photographers, event organisers, guests, sponsors, and affiliates. You must be at least 16 years old to create an account, worldwide, with no country exceptions. You can use TIME&SPACE at events anonymously (without an account) without any age restriction.

What TIME&SPACE is

TIME&SPACE is an event photo delivery platform. Here's what we do:

  • Photographers upload event photos (JPG, PNG, HEIC, etc.)
  • Event guests scan a QR code and take a selfie to find their photos using face recognition
  • We match the selfie to photos and show guests only their photos
  • Guests download their photos (optionally with watermarks)
  • Event organisers manage events, set pricing tiers, configure branding, and view analytics
  • We provide optional services: watermarking, sponsor management, roster automation, analytics

TIME&SPACE is a technology platform. We are not the photographer, organizer, or event operator. We facilitate delivery of photos. Responsibility for the quality, accuracy, and legality of the photos and events remains with the photographer and organizer.

Account registration

Who needs an account?

Photographers and event organisers must create accounts. Guests do not need accounts. They access photos via a public gallery link.

Account creation requirements

  • You must provide accurate, current information (name, email, etc.)
  • You must be at least 16 years old, worldwide. This applies in all regions with no exceptions.
  • One account per person. Multiple accounts are prohibited.
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activity under your account

Account security

  • Use a strong password
  • Never share your password or login credentials
  • Log out after each session on shared devices
  • Notify us immediately if you suspect unauthorized access
  • We are not liable for unauthorized access if you fail to secure your account

Account suspension & termination

We may suspend or terminate your account if you violate these terms, engage in illegal activity, abuse the platform, or fail to pay for services. We will provide notice where reasonably possible.

Event organisers

Your responsibilities

  • Inform guests about face recognition: You must tell guests that the platform uses face recognition to match photos. This must be communicated clearly at the event.
  • Obtain consent: Guests must explicitly consent to face recognition before scanning. This consent is logged for GDPR compliance.
  • Obtain photo consent: Guests must understand that photos will be taken and delivered through TIME&SPACE.
  • Verify photographer rights: Ensure all photographers have the right to upload photos to the platform (not violating third-party contracts).
  • Accurate event details: Provide accurate event information (date, location, photographer credits). Organisers are solely responsible for the accuracy of event details entered into the platform, including any information that may be surfaced to guests via platform features such as the AI Concierge assistant. TIME&SPACE is not liable for decisions guests make based on organiser-provided data.
  • Comply with laws: Ensure your event and use of photos complies with all applicable laws (e.g., GDPR, local privacy laws).

Pricing & payment

Events are available in three standard tiers, plus a Custom plan for large-scale productions:

  • STARTER: €188 • up to 500 guests, 1,500 photos, 60 days gallery access, analytics dashboard
  • ADVANCED: €488 • up to 2,000 guests, 5,000 photos, 90 days retention, analytics, custom branding, sponsor management
  • PRO: €888 • up to 15,000 guests, unlimited photos, 365 days retention, dedicated onboarding
  • CUSTOM: bespoke pricing • 15,000+ guests, full white-label (custom domain, complete removal of TIME&SPACE branding by agreement), dedicated onboarding, contact [email protected]

Optional add-ons (available on all plans, one-time purchase per event):

  • Sponsor Package: pricing announced at launch, sponsor logo on guest downloads, private sponsor analytics portal (available by arrangement, contact [email protected])
  • Roster Pro: €88 per event, upload named speakers or artists, automated face-matched photo delivery email to each person (available by arrangement — contact [email protected])

All tiers and add-ons require payment before activation. All prices are in EUR and exclude VAT. VAT is added at checkout where applicable.

Sponsor watermarks

If you activate a sponsor for an event, guest photo downloads will include a sponsor logo watermark. You are responsible for:

  • Having a valid agreement with the sponsor for logo use
  • Ensuring the sponsor logo does not infringe third-party rights
  • Informing guests that sponsored content may appear on their photos

TIME&SPACE applies watermarks at your instruction and is not party to your agreement with the sponsor.

Event ownership & access

You own the event. You can invite collaborators (photographers, team members) to manage the event. You can remove collaborators at any time. When your account is deleted, the event may be archived or deleted depending on retention settings.

Photographers & content owners

Photo ownership and platform licence

Photo ownership rests with whoever holds the copyright, typically the photographer who took the photos. The arrangement between a photographer and an event organiser regarding photo rights, usage, and exclusivity is governed by their own agreement and is not the responsibility of TIME&SPACE.

By uploading photos to TIME&SPACE, you (the uploader) confirm that you have the right to do so, and you grant TIME&SPACE a limited, non-exclusive, royalty-free licence to:

  • Store and process your photos
  • Apply face recognition and generate embeddings
  • Deliver photos to authorised guests at the event
  • Create thumbnails and compressed versions for display
  • Apply watermarks and branding as configured
  • Display photos in the event guest gallery

TIME&SPACE does not claim ownership of uploaded photos. This licence ends when photos are deleted from the platform.

Platform showcase licence (opt-out)

TIME&SPACE may feature event photos or screenshots of the platform (showing the guest gallery interface) on its website, social media channels, or marketing materials to showcase the product experience. This applies only to platform UI screenshots and non-identifiable gallery views, not to individual guest face photos.

This is an opt-out licence: By default, we may use your event for marketing purposes. However, if you do not want your event featured, you can:

  • Contact [email protected] at any time to request removal
  • Disable this feature in your event settings before the event goes live

We will remove your event from all marketing materials within 7 days of your request.

What you cannot do with TIME&SPACE

You agree NOT to:

  • Upload photos you don't have the right to distribute
  • Upload photos that violate model releases or third-party rights
  • Upload illegal, offensive, or harmful content
  • Use the platform for surveillance or non-event purposes
  • Claim that TIME&SPACE owns or endorses your photos

Warranty & representations

You warrant that:

  • You own or have the right to upload all photos
  • Photos do not infringe third-party intellectual property
  • Photos comply with all applicable laws
  • You have obtained necessary model releases and consent

Removal of photos

You may delete photos at any time. Once deleted, they are removed from the guest gallery and deleted from storage within 48 hours. TIME&SPACE may also remove photos that violate these terms.

Guests & participants

No account required

You don't need to create an account to access event photos. Just scan the QR code and follow the prompts.

Face recognition consent

Before your face is processed, you understand that:

  • Face recognition is a biometric processing operation (GDPR Article 9) requiring your explicit, affirmative consent
  • You must actively agree before your face is processed. Silence or inaction is not consent
  • You can refuse and still browse the event gallery by searching for photos without using face recognition
  • You can withdraw your consent anytime with no penalty
  • Your selfie image and face embedding are deleted after the event (or within 30 days)

Photo access duration

Event organisers choose how long photos are available (30, 90, or 365 days). After this period, photos and your gallery access are deleted.

Personal use only

Downloaded photos are for your personal use only. You may not:

  • Republish or redistribute photos publicly
  • Use photos commercially without consent
  • Sell or license photos
  • Claim copyright of the photos

Email notifications (optional)

You may optionally provide your email to receive notifications about photo matches. You can unsubscribe anytime.

B2C app: Guest profiles and social features

Guest profiles

Registered B2C users may create a guest profile to RSVP to events, follow other users, and access photo history across events. When you create a guest profile:

  • You own your profile. You may delete it at any time from Settings.
  • On deletion, your profile, matched photo records, RSVP history, follow relationships, and AI Concierge conversations are deleted within 48 hours.
  • Face embeddings associated with your account are deleted within 48 hours of account deletion.
  • Event photos in which you appear belong to the photographer. They are not deleted when you delete your account. Only the face match association linking those photos to your profile is removed.

Social features: acceptable use

TIME&SPACE social features (follows, RSVP visibility, event discovery) are for genuine personal use only. You agree not to:

  • Harass, threaten, or intimidate other users
  • Impersonate any person, organisation, or brand
  • Share intimate images or photos of others without their consent
  • Use fake accounts or automated tools to follow, RSVP, or manipulate discovery
  • Post hate speech or content that promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin
  • Spam other users or use the platform to send unsolicited commercial messages

RSVP privacy

By default, your RSVPs are visible to users who follow you, so they can discover events through your activity. You can set any RSVP to private in event settings. Private RSVPs are not shared with any other user, including via the AI Concierge.

Username and public profile

Organiser and Photographer accounts may set a username and activate a public profile page at timeandspace.app/u/[username].

Username rules

  • Usernames must be 3–30 characters, using only lowercase letters, digits, and hyphens.
  • Usernames cannot start or end with a hyphen, and cannot contain consecutive hyphens.
  • Usernames must be unique across the platform. We reserve the right to reclaim usernames that are inactive, impersonating, or in violation of these terms.
  • You may change your username once every 30 days. Frequent changes made to mislead or harm others may result in account suspension.

URL redirect on change

When you change your username, your old public URL (timeandspace.app/u/[old-username]) automatically redirects to your new URL for 90 days. After 90 days, the old username becomes available for others to claim. Your previous username is stored in our system during this window and deleted when it expires.

Public profile visibility

Your public profile is visible by default once you set a username. You can hide it at any time in Account Settings. When your profile is public:

  • Your display name, profile photo, bio, location, and social links are visible to anyone with the link.
  • Your event albums are listed on your profile. Individual photo privacy is controlled per-event.
  • Your account email, phone number, billing information, and private fields are never shown.

Username conduct

You may not use a username that:

  • Impersonates a real person, company, or brand you are not affiliated with
  • Contains or implies hate speech, slurs, or harassment
  • Is deceptively similar to TIME&SPACE official accounts
  • Is registered in bad faith (e.g., to block a legitimate owner from using it)

Violations may result in username removal or account suspension without prior notice.

Content moderation and DSA

TIME&SPACE is a hosting service under the EU Digital Services Act (DSA). We are required to act on illegal or violating content when notified. Our full content moderation policy, including a list of prohibited content, report processing timelines, and appeals process, is outlined in Section 3 of these Terms.

Reporting content

A "Report" button is available on all user-generated content on the platform (profile photos, comments, reactions). You can also email [email protected] with subject "Content Report".

Reports are reviewed within 5 working days (within 24 hours for CSAM or imminent harm). We will notify you of the outcome.

Consequences of violations

Violations of these terms or our content moderation policy result in:

  • First violation (minor): Content removed, warning issued
  • Second violation or first serious violation: Content removed, 7-day account suspension
  • Third violation or severe violation: Permanent account ban
  • CSAM or imminent harm: Immediate permanent ban and report to authorities

Appeals

If your content was removed and you believe the decision was incorrect, you may appeal within 14 days of the removal notification by emailing [email protected] with subject "Content Moderation Appeal". Appeals are reviewed by a different person than the original decision and resolved within 10 working days.

DSA contact point

For DSA-related requests from EU authorities or trusted flaggers: [email protected], subject: "DSA Request". TIME&SPACE is established in Portugal (EU) and is not required to designate a separate EU representative.

Referral programme

Transparency notice: If you signed up using someone's referral link, that person may receive a commission if you become a paying customer. Disclosed here under EU Directive 2005/29/EC and Portuguese consumer protection law. The commission does not affect the price you pay.

Eligibility

Any registered TIME&SPACE user may share their referral link, regardless of account type. This includes photographers, event organisers, DJs, artists, speakers, venues, and guests. No application or approval is required. This is a referral fee arrangement, not a commercial agency or employment relationship.

Commission rate

You earn a flat 10% of every paid event fee from organisers you refer, provided they create and pay for their first event within 90 days of signing up. There are no tiers, no caps, and no minimum referral volumes.

STARTER (€188): €18.80 commission

ADVANCED (€488): €48.80 commission

PRO (€888): €88.80 commission

Commission is 10% of the net event fee paid, before Stripe processing fees. Calculated and credited automatically on payment confirmation.

90-day commission window: Commissions are earned on payments made within 90 days of the referred organiser's account creation date. The referred organiser must create and pay for at least one event within this window. Events paid after this window do not generate commission. The window closing date is visible per referral in your dashboard.

Qualifying referrals

A referral qualifies only if the referred organiser is a new customer. A referral does not qualify if:

  • The referred email already exists in our system
  • The referred organiser has made any prior payment on the platform
  • The referrer and the referred organiser are the same person (self-referral is not permitted)
  • The referral was generated through fraudulent, incentivised, or automated means
  • The event payment is subsequently refunded under the 30-day money-back guarantee

Payout process

Payouts are initiated by you from your dashboard (Dashboard → Referrals → Request Payout). Minimum balance to request: €50. Payouts are processed on the 1st and 15th of each month via SEPA bank transfer to your IBAN.

When requesting a payout, you must provide your IBAN and NIF (tax identification number). You must issue a valid invoice (recibo verde or company invoice) to:

Payment is transferred within 5 business days of receiving a valid invoice. Tax liability on commission income rests entirely with the referrer. TIME&SPACE does not withhold tax.

Additional conditions

  • Geographic scope: Global, any user anywhere in the world may participate
  • Rate changes: We may adjust commission rates with 30 days notice to existing referrers. Changes affect future events only, already-earned commissions are unaffected
  • Programme cancellation: We may close the programme with 30 days notice. Verified pending commissions at closure are honoured upon invoice submission
  • Fraud: Fraudulent referral activity results in immediate account termination and forfeiture of all pending earnings
  • Disputes: Commission disputes must be raised within 60 days of the referred organiser's payment
  • Balance expiry: Pending earnings do not expire as long as your account remains active

Prohibited conduct

You agree not to:

Upload illegal, obscene, defamatory, or harmful content

Circumvent rate limits, security controls, or access restrictions

Scrape, crawl, or bulk download photos without permission

Use the platform for surveillance, tracking, or facial recognition outside event purposes

Reverse-engineer, decompile, or attempt to extract platform source code

Impersonate others or misrepresent your identity

Harass, abuse, or threaten other users

Distribute malware, viruses, or malicious code

Spam, phish, or launch attacks against the platform

Intellectual property

Your content ownership & GDPR data roles

You retain all copyright and intellectual property rights in photos and content you upload. TIME&SPACE claims no ownership.

Under GDPR, photographers and event organisers are data controllers responsible for processing guest data lawfully. TIME&SPACE acts as a data processor. You must:

  • Obtain explicit consent from guests for face recognition before data processing begins
  • Ensure you have the right to process guest photos and biometric data
  • Provide privacy notices to guests explaining face recognition and data handling
  • Respond to guest data access and deletion requests

Our platform

TIME&SPACE brand, logo, software, design, and technology are our intellectual property. You may not:

  • Copy or reproduce the platform code
  • Claim ownership of TIME&SPACE or use our brand without permission
  • Reverse-engineer or decompile the software
  • Create competing services based on our platform

Limited licence

We grant you a limited, non-exclusive, revocable licence to use TIME&SPACE for lawful event photo delivery. This licence does not permit resale, redistribution, or commercial use without written permission.

30-day money-back guarantee

We stand behind our platform. If you are not satisfied with TIME&SPACE for any reason, you may request a full refund within 30 calendar days of payment. No explanation required.

How to claim

Email [email protected] with your event name and the email address used at payment. We will process your refund within 7 business days. No questions asked.

Once a refund is issued, your event plan is cancelled and the event reverts to unpublished status. Any photos already delivered to guests remain accessible to those guests until the original event expiry date.

Conditions

  • The guarantee covers the event plan payment only (Starter, Advanced, Pro). It does not apply to add-on services or third-party products.
  • One refund claim per organisation per 12-month period. Repeat refund claims on the same tier will be reviewed on a case-by-case basis.
  • Not applicable if the account has been suspended for violation of these Terms, fraud, or abusive conduct.
  • The 30-day period is calculated from the Stripe payment confirmation timestamp.

This voluntary guarantee is in addition to, and does not replace, any statutory rights you have under applicable law, including the EU Consumer Rights Directive 14-day right of withdrawal where applicable.

Payments & refunds

Pricing

  • All prices are in EUR and exclude VAT
  • VAT is added at checkout where applicable under applicable law
  • Pricing may change, but we will notify you in advance

Right of withdrawal (EU digital services)

Under EU Consumer Rights Directive, you have the right to withdraw from your purchase within 14 days of payment. However, this right is lost once performance has begun (i.e., once your event is live and photos are being delivered to guests).

To withdraw: Contact [email protected] within 14 days of payment, before your event goes live.

Refund policy

Within 30 days of payment: Full refund available under our money-back guarantee (see section above). This applies regardless of whether your event has started.

After 30 days: No refunds once the 30-day guarantee period has expired, except where required by applicable law.

Disputes: Contact [email protected]. We resolve all payment disputes within 5 business days.

Payment method

Payments are processed by Stripe. We do not store your card details. By paying, you authorize Stripe to charge your payment method according to Stripe's terms.

Failed payments

If payment fails, your event will not go live. We will notify you of the failed payment. You have 7 days to retry payment or your event will be cancelled.

Warranty & liability

Service is "as-is"

TIME&SPACE is provided "as-is" without warranty of any kind. We do not guarantee:

  • Uptime or availability (we aim for 99.5%, but do not guarantee it)
  • Face recognition accuracy or speed
  • Photo delivery or quality
  • Data security or recovery after loss
  • No service interruptions or bugs

Liability limits

We are not liable for:

  • Data loss, corruption, or failure to upload
  • Service downtime or unavailability
  • Inaccurate face recognition (missed matches, false positives)
  • Third-party service failures (Stripe, Supabase, Vercel)
  • Indirect, incidental, or consequential damages (lost profits, lost revenue)
  • Loss of reputation or business opportunity

Liability cap

Our total liability to you is limited to the amount you paid for the service in the 12 months prior to the claim. If you paid nothing, our liability is €0.

These limitations do not apply to death, personal injury, fraud, or consumer rights that cannot be waived by law.

Your responsibilities (indemnification)

You agree to defend, indemnify, and hold harmless TIME&SPACE, our founders, and our team from any claims, damages, costs, or losses arising from:

  • Your violation of these terms
  • Your upload of photos that violate third-party rights (copyright, privacy, likeness)
  • Your failure to obtain model releases or consent
  • Your use of TIME&SPACE for illegal purposes
  • Claims by guests that their image rights were violated
  • Disputes between you and your collaborators or customers

In other words: if your photos or conduct causes legal trouble, you cover the costs.

Account termination

We may terminate your account if you:

  • Violate these terms
  • Engage in illegal or harmful activity
  • Abuse the platform or other users
  • Fail to pay for services
  • Use the platform for non-event purposes (e.g., surveillance)
  • Repeatedly upload violating content

You can delete your account anytime

You can request account deletion through your dashboard settings. Upon deletion:

  • Your account and photos are deleted within 48 hours
  • Your events are archived (not accessible to guests)
  • You may not recover deleted data
  • No refunds are issued

Effect of termination

Termination ends your right to use TIME&SPACE. Sections on intellectual property, liability, and indemnification survive termination.

Disputes & governing law

Governing law

These terms are governed by Portuguese law and EU regulations (especially GDPR). All mandatory consumer protections under EU law apply to you. The legal entity operating this platform is Welcome Objective Unipessoal Lda, NIF 517881721, registered in Lisbon, Portugal, trading as TIME&SPACE.

Dispute resolution

Step 1: Good-faith negotiation. Contact [email protected] with your dispute. We will respond within 30 days.

Step 2: Mediation. If unresolved, we will attempt mediation in good faith.

Step 3: Litigation. Disputes will be resolved in the courts of Lisbon, Portugal. EU consumers may also use the EU Online Dispute Resolution platform.

Jurisdiction

You consent to the exclusive jurisdiction of Portuguese courts (Court of Lisbon) for any legal proceedings. If you are a consumer in the EU, you may also sue in your home country's courts.

Changes to these terms

We may update these terms. Material changes will be notified via email and on this page. Continued use after changes means you accept the new terms. If you do not agree, you must delete your account.

Severability

If any part of these terms is found invalid or unenforceable, the rest remain in effect. If a term is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable.

Consumer protection notice

These terms apply to all users. However, if you are a consumer in the EU or other jurisdictions with mandatory consumer protection laws, those protections cannot be waived or limited by these terms. This includes:

  • Your statutory right to a refund within 14 days of purchase (before performance begins)
  • Your rights under GDPR regarding personal and biometric data
  • Your right to dispute and seek remedies under your national consumer laws
